4. K-pop Content and Lists

MyKpopLists is a platform for creating, sharing, and discovering K-pop related content including but not limited to artist rankings, song lists, album reviews, and fan discussions. All content related to K-pop artists, music, and culture must be respectful and factual. False information about artists, malicious rumors, or defamatory content will result in immediate content removal and potential account suspension.

5. User-Generated Content

Users may post, upload, or otherwise contribute content to the Service ("User Content") including lists, reviews, comments, ratings, and discussions. You are solely responsible for your User Content. By posting User Content, you grant MyKpopLists a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, publish, distribute, and display such content in any media.

You represent and warrant that you own or have the necessary rights to the User Content you post and that its use does not violate the rights of any third party or any applicable law. MyKpopLists has the right, but not the obligation, to monitor, edit, or remove any User Content at our sole discretion.

6. Community Guidelines and Rules of Conduct

MyKpopLists is committed to maintaining a positive, respectful community for K-pop fans. You agree not to use the Service to post or transmit any User Content that:

• Is unlawful, threatening, abusive, defamatory, obscene, vulgar, or otherwise objectionable.
• Promotes illegal activities, racism, bigotry, hatred, or physical harm of any kind against any group, individual, or K-pop artist.
• Contains hate speech, harassment, or cyberbullying directed at K-pop artists, other users, or any individuals.
• Spreads false information, malicious rumors, or unverified claims about K-pop artists or industry figures.
• Infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party, including K-pop entertainment companies.
• Constitutes "spam," "junk mail," or any form of unauthorized solicitation.
• Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware.
• Promotes or facilitates piracy of K-pop music, videos, or other copyrighted content.
• Engages in fan wars, toxic behavior, or attempts to incite conflict between different fandoms.
• Shares private or personal information about K-pop artists without consent (doxxing).
• Creates fake accounts or impersonates K-pop artists, industry figures, or other users.

7. Prohibited Activities

The following activities are strictly prohibited and may result in immediate account suspension or termination:

• Vote manipulation, bot usage, or artificial inflation of rankings and ratings.
• Creating multiple accounts to circumvent restrictions or manipulate content.
• Harassment campaigns or coordinated attacks against users or artists.
• Sharing or distributing copyrighted K-pop content without proper authorization.
• Attempting to hack, disrupt, or compromise the security of the Service.
• Commercial use of the platform without explicit permission from MyKpopLists.

8. Account Suspension and Banning Policy

MyKpopLists reserves the right to suspend or permanently ban user accounts for violations of these Terms of Service. The severity and duration of penalties will depend on the nature of the violation:

• Warning: First-time minor violations may result in a warning and content removal.
• Temporary Suspension: Repeated violations or moderate offenses may result in temporary account suspension (1-30 days).
• Permanent Ban: Severe violations including harassment, hate speech, doxxing, or repeated offenses will result in permanent account termination.

Banned users are prohibited from creating new accounts. Attempts to circumvent bans will result in immediate permanent suspension of all associated accounts.

9. Intellectual Property and K-pop Content

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of MyKpopLists and its licensors. The Service is protected by copyright, trademark, and other laws.

K-pop related content including music, videos, images, and other materials are the property of their respective owners, including but not limited to entertainment companies, artists, and distributors. Users must respect these intellectual property rights and not engage in unauthorized distribution or piracy.

10. Copyright Infringement (DMCA Policy)

We respect the intellectual property rights of K-pop artists, entertainment companies, and all content creators. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material that is claimed to be infringing and where it is located on the Service.
• Your contact information, including address, telephone number, and email address.
• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

MyKpopLists makes no warranties, expressed or implied, and hereby disclaims all other warranties, including without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free.

15. Limitation of Liability

In no event shall MyKpopLists, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, or other intangible losses, resulting from your access to or use of or inability to access or use the Service, whether based on warranty, contract, tort (including negligence) or any other legal theory.

16. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within the United States for the resolution of any disputes.
